SHIPPING POLICY

KRISHNA MADHAV reserves the right, at its sole discretion, to change, modify, add, or remove portions of this Policy, at any time without any prior written notice to the User. It is the User’s sole responsibility to review this Policy periodically for updates or changes. The User’s continued use of the Website following the posting of changes shall be deemed to mean that the User accepts and agrees to the revisions. Users are advised to refrain from ordering Products if they do not agree with the terms and conditions of this Policy.

This Policy is to be read with the Terms of Use available at Privacy policy, Privacy Policy available at Privacy policy and the respective contracts if any, entered into between KRISHNA MADHAV and the User. This Policy shall be deemed to be incorporated into any such contract entered into with KRISHNA MADHAV. In the event of any inconsistency between the shipping and delivery terms provided in the contract and this Policy, the provisions of this Policy shall prevail.

For the purpose of this Policy, all capitalised terms shall have the meaning so assigned to them in the Terms of Use.

Shipping Charges

The Products ordered by the User pursuant to the placement of orders with KRISHNA MADHAV will be shipped by KRISHNA MADHAV subject to payment of charges for dispatch and delivery of the Products (“Shipping Charges”). The Shipping Charges for the Products purchased by the User will be pre – paid and charged to the User at the time of purchasing the Product from KRISHNA MADHAV to the invoice provided to the User evidencing purchase of the Product. In the event the Products are purchased by the User vide purchase orders, the Shipping Charges will be mentioned in the invoice corresponding to the relevant Purchase Order. The delivery of Products will be carried out by KRISHNA MADHAV’s delivery partners based on the mode and route for transportation of Products selected by KRISHNA MADHAV. The User may choose to receive delivery of the Products through the delivery partner selected by KRISHNA MADHAV or a delivery partner of its own choice. The Shipping Charges will be calculated on the basis of the option selected by the User. Notwithstanding anything stated herein, KRISHNA MADHAV reserves the right to change the mode, route, or delivery partner for the purpose of delivery of Products. KRISHNA MADHAV shall collect a portion of the Shipping Charges viz. a sum amounting to INR 5000/- (Rupees Five Thousand only) per Product from each User at the time of placement of the order (500). The remaining amount of Shipping Charges will be paid by the User to the distributor or Dealer, as the case may be, by virtue of payment links as shared by KRISHNA MADHAV at the time of making the Purchase. The User will be responsible for and will promptly pay, all taxes of any kind associated with the shipping of the Products.

Delivery Timeline

Delivery will be done in India in 7 to 10 days if the order does not reach through courier in 7 days then we will refund your order money.

Delivery Schedule

Products ordered by Users will be procured and shipped on and from March 2022 on a first cum first serve basis. The estimated delivery time for the Products depends upon factors such as availability of final ready to ship Products with the Seller and the destination to which the User wants the Products to be shipped to and the delivery partner’s time required to deliver the Products to the User’s location. The term “business day” means a day other than Saturday or a Sunday or bank holiday in Jodhpur, India. It is possible that there may be a holiday between the date of the order and date of delivery which is communicated in the timelines shown to you while placing the order. In such cases, such number of additional day(s) is added to the estimated date of delivery. The Products will be delivered within the delivery timelines as specified in the order summary received along with the invoice of the Products generated pursuant to placement of orders by the User. In the event the order is received through the placement of purchase orders, the Product delivery timelines will be specified in such purchase orders. KRISHNA MADHAV will not be responsible for any loss or damage incurred due to delay of delivery of Products for any reason beyond its control.

Sale and delivery of Products entirely depends upon factors such as:

KRISHNA MADHAV undertaking the shipping and delivery of Products in the User’s location;

restrictions as under Applicable Law, in shipping of Products to the User’s location;

availability of delivery partner in the User’s location; and

such other factors as may be considered by KRISHNA MADHAV during the course of its operations.

The User shall produce, at the time of taking delivery of Products, all documents in its original form. If the User does not produce any of the required documents, KRISHNA MADHAV reserves the right to withhold delivery of Products at the entire costs and expenses of the User.

Tracking of Deliveries

Users will receive notifications from the delivery partner upon booking of the Product. Thereafter, User will be notified by the delivery partner at the time of dispatch of the Products and status of the Products in transit. Delivery partner will share a tracking link to enable the User to ascertain the progress of each shipment of Products on a real – time basis.

Packaging

The Products will be packed by KRISHNA MADHAV before shipping in packaging material as per the parameters required under Applicable Law. All Products will be delivered under the brand name of KRISHNA MADHAV.

Risk of Loss and Insurance

KRISHNA MADHAV shall not be responsible for any loss or damage to the Product after the Product has been dispatched to the User from its factory/manufacturing facility. The risk of loss or damage with respect to any consignment of Product shall pass to the User, as and when such consignment of Product is dispatched by KRISHNA MADHAV from its factory/manufacturing facility.

The User shall obtain appropriate insurance coverage for such dispatched Products and shall be responsible for any loss or damage that may be caused to the Products thereafter.

Customs Compliance

Once the order is placed for purchase of Products, KRISHNA MADHAV will prepare for dispatching the Product to the location specified by the User. KRISHNA MADHAV will share the bill of lading to the User for evidencing proof of dispatch of the Products.

All logistics expenses including without limitation taxes, insurance, freight, custom duties, and overtime charges for the delivery of Products to the User will be borne exclusively by the User.

Return and Refunds

In order to discuss returns of Products purchased, please write to KRISHNA MADHAV at [insert email address] highlighting the reasons for return of Products requested and KRISHNA MADHAV would be happy to contact you for addressing the issue. No claims for return of Products will be entertained after 10 days of taking possession of such Products.

All requests for refunds as addressed to KRISHNA MADHAV will be processed in accordance with the refund policy

Liability

KRISHNA MADHAV will not be held responsible for non – delivery or delay in delivery due to incorrect information and particulars provided by the User while placing the order. In such an event, the booking is liable to be cancelled and the Shipping Charges will be borne by the User.

KRISHNA MADHAV assumes no liability for any damage incurred at the time of effecting the delivery, lodging, or shipping of Products. All claims with respect to the damages may be raised directly with the delivery partner.

In the event an order is cancelled by the User prior to dispatch of Products, KRISHNA MADHAV will refund the Minimum Amount to the User within 10 (ten) days from the effective date of cancellation of such order.

In no event will KRISHNA MADHAV be liable to the User for any indirect, special, consequential, or incidental damage or loss of revenue or business profits, however caused, regardless of the nature of the claim, even if advised of the possibility of such damages.

Subject to the above and notwithstanding anything to the contrary contained in these Terms, the maximum aggregate liability (whether in contract, tort (including negligence) or equity) of KRISHNA MADHAV vis-à-vis any User, regardless of the form of claim, be INR 100/- (Rupees One Hundred only).

Miscellaneous Terms

For the purposes of this Policy, all the miscellaneous provisions (including without limitation, governing law, jurisdiction, dispute resolution and miscellaneous clauses) shall be interpreted as provided under the Terms of Use.
